Divorce Process

Divorce ProceedingsIt is important that you not only understand the requirements for you to prove that you have tried everything within your power to repair a broken marriage but also understand the divorce proceedings and the stages that you need to negotiate:

Stage 1 – Application For Divorce

If you have been married for more than one year and are sure that your marriage has “irretrievably broken down" (cannot be saved), you can apply for divorce on the following established grounds:

  1. Adultery. Your spouse has committed adultery and you do not believe that your relationship can recover.
  2. Desertion. Your spouse deserted you more than two years ago and you wish to end the relationship.
  3. Five-Year Separation. You have been separated for five years and wish to file for divorce.
  4. Two-Year Separation with Consent. You have been separated from your partner for two years or more and they agree to divorce.
  5. Unreasonable Behaviour. Your partner has behaved in such a way that you cannot reasonably be expected to live together.

Stage 2 – Acknowledgement of Service

The County Court will check through your divorce petition (form applying for the divorce and statement of arrangements form, if applicable) and forward it to your partner, who will receive instructions on how to complete the ‘Acknowledgment of Service’ form.
This will confirm if the divorce will be opposed and other general information.

When it has been completed and sent back to the Court, you can apply for your Decree Nisi.

Stage 3 – Application for Decree Nisi

The Decree Nisi application asks the Court to put your divorce petition and supporting documentation before a Judge in order for him or her to consider whether to grant the first stage of your divorce.

Stage 4 – Application for Decree Absolute

After the declaration of your Decree Nisi, you will need to wait a further 43 days, before you are able to apply for a Decree Absolute. Again, your Full Service Divorce lawyer will make your application for your Decree Absolute to the County Court on your behalf. This is the actul document which will bring your marriage to an end.They will go through all the necessary questions with you and complete the form. The Court will then declare your marriage dissolved.

Stage 5 – Clean break agreement

Once your divorce is under way, it is vital that you obtain a clean break agreement which is legally enforceable. If this is not done, your partner could claim entitlement to a substantial amount of your estate or anything that you accrue even after the completion of the divorce. Stage 6 – Move on with your life

Once your divorce is confirmed by the County Court, you are free to move on with your life, and will be in a better position to do so, having completed the divorce proceedings faster and for far less money than you would have using a conventional solicitors firm.
